Terms and Conditions

General

These Terms and Conditions describe the MoneyLion Rewards Program (the “Rewards Program”), offered by MoneyLion Technologies Inc. and its affiliates (collectively, “MoneyLion”) to its users, and constitutes an agreement between you and MoneyLion.  These Terms and Conditions are supplemental to any other agreements you enter into with MoneyLion and its service providers, including, without limitation, the MoneyLion Terms of Service and the MoneyLion Privacy Policy, each as modified from time to time. Your use of your MoneyLion account or any feature of the Rewards Program indicates your acceptance of these Terms and Conditions, including after any changes are made to these Terms and Conditions.

Overview

The Rewards Program allows a MoneyLion user to earn promotional points (“Rewards Points”) redeemable for cash credits to the user’s RoarMoney℠ demand deposit account (each, a “Deposit Account”) provided by Pathward®, N.A. (“Pathward”) or the user’s MoneyLion Investment Account managed by MoneyLion’s subsidiary, ML Wealth LLC (each, an “Investment Account”), or for such other items as may be designated by MoneyLion from time to time (“collectively, the “Rewards”).

Eligibility and Participation

By signing up for a MoneyLion account, you will automatically be enrolled in the Rewards Program and will have the opportunity to earn Rewards Points. In order to earn Rewards Points, you must (a) have an active MoneyLion account in good standing, (b) be a legal resident of the 50 United States or the District of Columbia who has reached the age of majority in your state or territory of residence and (c) download the MoneyLion mobile application (the “MoneyLion App”). 

To redeem Rewards Points you have earned for cash credits to your Deposit Account, you must be a MoneyLion member in good standing (including being current on any required payments to MoneyLion) and have a Deposit Account established at Pathward in good standing. Additionally, in order to redeem your Rewards Points for cash credits to your Investment Account, you must have an Investment Account in good standing. You will forfeit your Reward Points if your MoneyLion account is not in good standing at the time you earn the Reward Points or if you are otherwise unable to receive the Reward Points.

Fees

There are no direct fees charged by MoneyLion to participate in the Rewards Program and earn Rewards Points. However, there may be fees associated with the redemption of your Rewards Points, including the monthly account administrative fees associated with both the Deposit Account and the Investment Account, which will apply to you when you open the Deposit Account and/or Investment Account, as applicable, to redeem your Rewards Points. Reward Points

You may earn Rewards Points by completing such qualifying actions or satisfying such other qualifying criteria that MoneyLion designates from time to time as subject to the Rewards Program (the “Qualifying Actions”). The number of Rewards Points that may be earned for such Qualifying Action will be determined by MoneyLion in its sole discretion. If a Qualifying Action is a limited time offer, MoneyLion’s clock is the official timekeeper of the relevant time period for such Qualifying Action.

The Qualifying Actions may include, among other things: successfully completing transactions or other actions on the MoneyLion App with respect to MoneyLion’s products, services, tools and features; successfully applying for and/or enrolling in a product or service offering of MoneyLion’s third-party partners, as determined by the applicable third-party partner in its sole discretion; engaging with MoneyLion’s posted content on the MoneyLion App or its official social media channels, including Instagram, X, TikTok and/or Facebook; or other special promotions that  MoneyLion may offer from time to time. The exact requirements to earn Reward Points for a Qualifying Action, the duration of the offer and expiration date, if any, and other important information will be included in the description of the relevant Qualifying Action at the time of the offer, as well as in the “Missions” tab in the MoneyLion App and the Rewards Program Frequently Asked Questions available at help.moneylion.com. The natural expiration of a limited time offer to earn Rewards Points through a Qualifying Action is not a modification to the Rewards Program that requires notification.

Qualifying Actions may implicate and require your agreement to additional agreements and/or terms and conditions, including those of MoneyLion’s third-party providers and partners. MoneyLion may further implement certain restrictions relating to the receipt or use of Reward Points, as communicated to you from time to time.

Reward Points will be rewarded promptly following completion of the Qualifying Action, subject to any circumstances that may delay the deposit of the Reward Points, and will generally be available for redemption immediately. Your Rewards Points balance will be updated in your MoneyLion account, accessible via the MoneyLion App, promptly after you earn and redeem Reward Points. Unless specifically authorized by MoneyLion, Rewards Points may not be combined with other discounts, special rates or other reward programs offered by MoneyLion or Pathward. 

Determination of whether you have successfully completed a Qualifying Action and earned Reward Points shall be made by MoneyLion in its good faith discretion. If you believe that you have validly earned Rewards Points that have not been posted to your account, please contact MoneyLion’s Customer Care team for assistance. MoneyLion’s decisions regarding Reward Points discrepancies shall be final. MoneyLion does not determine the eligibility criteria of its third-party partners and is therefore not responsible or liable for any determinations made by its third-party partners regarding eligibility for any offer or for determining whether or not you have completed all necessary steps to successfully complete a Qualifying Action with respect to a third-party offer.

Redemption Methods

Each Reward Point is the equivalent of $0.01.  Your Rewards Points balance is expressed in your account as dollars, and each $1.00 earned is equal to 100 Rewards Points. To redeem Rewards Points, go to the “Rewards” tab in the MoneyLion App, click on your Rewards Points balance and then follow the steps to redeem the Rewards Points. Rewards Points may be redeemable in any manner authorized by MoneyLion once you have earned a minimum of 100 Rewards Points (the equivalent of $1.00) and are currently redeemable as cash credits in the following accounts:

  1. Deposit Account

    For any Rewards Points that are redeemed as a credit to your Deposit Account, those funds will be subject to all of the terms and conditions of your Demand Deposit Account Agreement, available here. Funds are FDIC insured, subject to applicable limitations and restrictions, when Pathward receives the funds deposited to your account.

  2. Investment Account

    For any Rewards Points that are redeemed as a credit to your Investment Account, those funds will be subject to all of the terms and conditions of your Investment Advisory Agreement with ML Wealth LLC and ML Wealth LLC’s Form ADV, available at https://moneylion.com/adv. Among other things, funds in your Advisory Account are not FDIC insured, may lose value and are subject to a periodic account administrative fee.

MoneyLion reserves the right to modify the manner in which Rewards Points may be redeemed, including to add new redemption mechanisms from time to time. All redemptions are final, and no refunds or returns of Rewards Points will be given once a redemption has been made. 

You may see “cash back” and similar phrases in marketing materials when referring to the Rewards Program, any Qualifying Actions and the rewards you may earn.  Notwithstanding any such terminology, Rewards Points are earned as points and have no cash value until they are redeemed pursuant to these Terms and Conditions.

Expiration

Your unredeemed Rewards Points will expire upon the earlier of (a) the date that you no longer have a MoneyLion account in good standing (including if your action is closed for misuse, fraud or any other permitted purpose) and (b) 365 days after the date that you last earned Reward Points. Unless MoneyLion has made an error, your Rewards Points will not be reinstated after expiration.

Miscellaneous

These Terms and Conditions are subject to modification from time to time for any reason or no reason at MoneyLion’s sole discretion. MoneyLion may also supplement these Terms and Conditions to introduce new promotions or modify existing promotions. MoneyLion may also cancel the Rewards Program at its sole discretion. MoneyLion may provide notice of changes to the Rewards Program and these Terms and Conditions as and if required by applicable law and will provide a minimum of 45 days notice before the Rewards Program is modified, canceled, closed or terminated in any way that is less favorable to you, after which you will have a minimum of 90 days to redeem your Rewards Points unless if you have engaged in fraud or misuse of the Rewards Program. 

The Rewards Program is void where prohibited by federal, state or local law. Rewards Points are non-negotiable and cannot be redeemed for any benefit except those designated by MoneyLion. Unless required by applicable law, Rewards Points are not your property and may not be brokered, bartered, attached, pledged, gifted, sold, or unless specifically authorized by MoneyLion. Additionally, Rewards Points may not be transferred to anyone else under any circumstances, including, but not limited to disability, death or in connection with any domestic relations dispute and/or legal proceeding. 

The Rewards Program is provided for personal, family and household use only. MoneyLion can immediately suspend or disqualify you from the Rewards Program, in whole or in part, at any time and for any reason. MoneyLion will suspend or disqualify you from the Rewards Program if you or anyone associated with your MoneyLion account, Deposit Account, Investment Account or other account you have with MoneyLion (a) violates these Terms and Conditions, any terms and conditions governing your MoneyLion account, Deposit Account, Advisory Account or other account you have with MoneyLion, (b) engages in fraud or suspected fraud, misuses or games the Rewards Program or (c) takes another similar action, as determined by MoneyLion in its sole discretion. If MoneyLion suspends or cancels your participation in the Rewards Program, (1) you may be temporarily or permanently prohibited from earning and/or using Rewards Points, (2) you may lose any previously earned Rewards Points, and/or (3) MoneyLion may close your MoneyLion account, Deposit Account, Advisory Account or other account you have with MoneyLion. 

You agree to release MoneyLion, Pathward and their respective affiliates, directors, officers, partners, members, employees, contractors, service providers, agents, representatives and other parties associated with the Rewards Program (collectively, the “Released Parties”) for all activity in connection with the Rewards Program, including the receipt and use of Rewards Points. The Released Parties make no representations or warranties, either express or implied, including those of merchantability, fitness for intended use or a particular purpose and otherwise arising by law, custom, usage, trade practice, course of dealing or course of performance. The Released Parties shall not be liable for incidental, punitive, exemplary, indirect or consequential damages (including lost profits), and the sole extent of liability, if at all, shall not exceed the actual value of the Rewards Points you earn. Furthermore, you agree to indemnify and hold the Released Parties harmless from and against any loss, damage, liability, cost or expense of any kind (including reasonable attorneys’ fees) arising from your use of Rewards Program, any fraud or misuse of the Rewards Program by you and your violation of these Terms and Conditions.

Reward Points that you redeem under the Rewards Program may be deemed taxable income from MoneyLion in the year in which they are redeemed pursuant to U.S. tax law. If the value of Reward Points you receive in a year and any other taxable miscellaneous income you receive from MoneyLion equals $600 or more for a calendar year, MoneyLion may be required to send you a Form 1099-MISC or other applicable tax form for that year and submit such form to the IRS. MoneyLion determines the tax value of any Reward Points you receive for tax purposes. You are responsible for determining any personal tax liability arising from participation in the Rewards Program. Consult your tax advisor concerning tax consequences.

You are responsible for all transactions and other activities relating to your participation in the Rewards Program, including how you choose to redeem your Rewards Points. As the administrator of the Rewards Program, MoneyLion is solely responsible for the terms and conditions of your participation in the Rewards Program, your eligibility for Rewards and any tax withholding or reporting obligations relating to the  Rewards Program. None of MoneyLion’s service providers or partner banks, including Pathward, have any duties, obligations or relationship with respect to the Rewards Program. Pathward is not affiliated in any way with the Rewards Program and does not endorse or sponsor the Rewards Program.

MoneyLion is a financial technology company, not a bank. The RoarMoney℠ demand deposit account is provided by, and the MoneyLion Debit Mastercard® issued by, Pathward®, National Association, Member FDIC. RoarMoney is a service mark of MoneyLion. Mastercard is a registered trademark, and the circles design is a trademark of Mastercard International. Funds are FDIC insured, subject to applicable limitations and restrictions, when we receive the funds deposited to your account.

The Rewards Program is in no way sponsored, endorsed or administered by Pathward, Mastercard or any other third party.  Neither Pathward, Mastercard nor any other third party has any responsibility or liability with regard to the Rewards Program.

MoneyLion does not provide, nor does it guarantee, any third-party product, service, information, or recommendation. The third parties providing these products or services are solely responsible for them, as well as all other content on their websites. MoneyLion is not liable for any third party’s failure with regard to those advertised products, services, and benefits. These advertised products and services may not be FDIC insured or bank-guaranteed, and may be subject to a different privacy policy than MoneyLion’s. You should check individual offers, products, and services to become familiar with any applicable restrictions or conditions that may apply.
